SICPA explains its support for much stronger legislation on tobacco products
With its extensive experience of working with governments to protect citizens against trade in illicit products, SICPA wishes to officially explain its point of view concerning the draft Federal legislation on tobacco products that moved into the consultation phase on 21 May.
In its response sent to the Swiss Federal authorities as part of the consultation process, SICPA supports the measures that have been proposed, viewing them as a necessary basis for new regulation on tobacco products. However, it believes these measures need to be significantly strengthened to make them fully effective.
Combating the illicit trade in low-priced, sometimes counterfeited, cigarettes is an important part of health policies aimed at reducing young people’s access to tobacco. To ensure that these efforts are effective, adequate means of control are crucial. "Track and Trace" systems provide such complete control of the supply chain and the draft Federal legislation represents the logical legal basis to bring them into force. It should be amended accordingly.
These “Track and Trace” solutions are, in fact, included in the World Health Organisation Framework Convention on Tobacco control, (WHO–FCTC). This framework convention was signed by Switzerland in 2004 and the Federal Council plans to ratify it during a second stage when the law comes into effect. It lays down certain fundamental principles, particularly concerning the independence of track and trace systems from the tobacco industry to ensure that the controlee cannot also be the controller.
If the authorities reinforce the first measures proposed by adding traceability that is independent of the tobacco industry, they will be respecting the intention of the Federal Council to implement the requirements of the WHO framework convention to combat the illicit tobacco trade effectively and protect the health of its citizens.

SICPA Stellungnahme: Nötige Verbesserungen im Entwurf des Bundesgesetzes über Tabakprodukte (TaPG):
SICPA nimmt im Rahmen der Vernehmlassung zum Entwurf des Tabakproduktegesetz (TaPG) Stellung.
SICPA begrüsst die neuen Vorschriften als notwendige Grundlage für eine Reglementierung der Tabakprodukte. Allerdings braucht es signifikante Verbesserungen am Gesetzesentwurf. Nur so können vorgesehene Massnahmen ihre vollständige Wirkung entfalten.
Der Kampf gegen den illegalen Handel mit – häufig gefälschten – Zigaretten, die zu niedrigen Preisen angeboten werden, ist ein wichtiger Teil jeglicher Tabakpräventions- und Gesundheitspolitik. Diese zielt insbesondere darauf ab, Jugendlichen den Zugang zum Tabak zu erschweren.
Um in diesem Kampf erfolgreich zu sein, sind entsprechende Kontrollmassnahmen unabdingbar. «Track und Trace» Systeme gewährleisten die lückenlose Kontrolle der Lieferkette. Das Tabakproduktegesetz stellt die logisch gesetzliche Basis dar, um entsprechende Massnahmen verankern zu können. Der Entwurf des Tabakproduktegesetzes ist entsprechend zu ergänzen.
Das Rahmenübereinkommen der Weltgesundheitsorganisation zur Eindämmung des Tabakgebrauchs (WHO – FCTC) verpflichtet dazu, «Track und Trace» Systeme einzuführen. Die Schweiz hat das Rahmenübereinkommen 2004 unterzeichnet, der Bundesrat plant nach Inkrafttreten des Tabakproduktegesetzes dessen Ratifizierung. Insbesondere betont das Rahmenübereinkommen, dass jegliche Massnahmen unabhängig von der Tabakindustrie zu treffen sind. Kontrolle und Kontrolleur dürfen nicht eins sein.
Die gesetzliche Verankerung einer von der Tabakindustrie unabhängigen Rückverfolgbarkeit entspricht dem Willen des Bundesrats, die Forderungen des Rahmenübereinkommens der WHO in die Tat umzusetzen, effektiv gegen illegalen Handel vorzugehen und damit die Gesundheit der Bürgerinnen und Bürger zu schützen.
